Intelligirl, Inc. will not accept credit card orders from children under 18 years of age who do not have permission from a parent or guardian. When ordering, the person ordering must certify that he or she is either above the age of 18, or is 13 years of age with parental permission. This electronic certification of parental permission for users ages 13 to 17 years is equal to and constitutes a legal signature that the person placing the order is over the age of 13 years and has permission from a parent or guardian to proceed and to place a credit card order. A child under the age of 13 may Register for the purposes of saving customized works-in-progress using a knick-name. Intelligirl, Inc. does not collect personally identifying information from children under 13 years of age, but may collect non-identifying information for internal marketing purposes. Upon registering using a knick-name, Intelligirl, Inc. does ask children under the age of 13 for an email address for one-time use solely for the purpose of requesting parental permission for the child to visit the Intelligirl Jewelry Maker website and associated website pages and use the website features, except for placing orders and purchasing products, . Responding to the link in the parental permission email constitutes parental permission for the child to visit the Intelligirl, Inc. website and use the website features.

5. Pricing Policies

Intelligirl Jewelry Maker uses a tier system to determine the price of jewelry you customize in the Make Jewelry portions of the website. At the beginning of your project, you will be asked to select a "Jewelry Box". Each Jewelry Box has a specific assortment of beads to use in your custom jewelry projects, and each Jewelry Box has its own schedule of pricing for earrings, bracelets, and necklaces. You may view prices on the Custom Jewelry Pricing Chart.

You may view the contents of each Jewelry Box prior to your selection of a Jewelry Box.

Intelligirl, Inc. also sells pre-made jewelry pieces and other bead related items such as craft kits, both manufactured by Intelligirl, Inc. and by third party manufacturers, in a Online Retail Store on the Intelligirl Jewelry Maker website. Prices are displayed for each product on the website.

Prices of custom and non-custom merchandise do not reflect the total price of your order. You will also be charged for shipping your order and charged any applicable sales tax.

With respect to retail items sold by Intelligirl, Inc. on the Intelligirl Jewelry Maker website, despite our best efforts, an item may be mispriced. If an item's correct price is lower than the stated price, we will charge you the lower price. If an item's correct price is higher than the stated price, we will contact you and give you the option of paying the correct higher price or canceling your order.

6. Product Descriptions - Custom Bead Quality and Availability

Intelligirl, Inc. and its affiliates attempt to be as accurate as possible when describing products for sale in our Online Retail Store or when describing items and objects available for the customer to use in customization projects. However, Intelligirl, Inc. does not warrant that product descriptions or other content of this site are accurate, complete, reliable, current, or error-free. Intelligirl, Inc. is additionally not responsible for product misrepresentations due to variances in your computer equipment or Internet access features. Please read our Return Policy carefully.

Beads vary in color, texture, shape, size, and other features due to normal manufacturing conditions. Intelligirl, Inc. is not responsible for these variations. By placing your order with Intelligirl, Inc., you understand and agree to the fact that individual beads may vary from what is pictured on our website.

From time to time, the beads offered in the five Jewelry Boxes on our website, will not be available due to unavoidable stock fluctuations. In the event that you submit an order that contains an unavailable bead, you will be contacted by email or telephone and given a chance to modify your bead selection and re-place your order with a different bead or beads. Your choice of new bead or beads may change the price of your order.

Some beads vary in color naturally, such as our Carnelian Arrows, or our Jasper Hearts. Intelligirl, Inc. and its manufacturers can not be responsible for normal color variation and are not responsible if you are disatisfied with the bead you get. We will make an attempt to give you a sense of the color variation in the picture representations of beads on our website, but we can not be held liable for color variations that are a natural part of some beads. In the event that you select to use a bead that varies in color, our Return Policy is in full effect.

7. Ordering Policies

All orders submitted by you to Intelligirl, Inc. constitute offers to purchase which are subject to acceptance or rejection by Intelligirl, Inc. The company's acceptance of any order from you is expressly conditional upon your assent to these Terms of Service. Intelligirl, Inc. expressly limits acceptance of your order to these Terms of Service. Any additional or different terms proposed by you in any manner are expressly rejected.

Currently, Intelligirl, Inc. only accepts payment by credit card. Your credit card payment is processed and handled by a secure third-party, YourPay.com, a site that uses encryption technology to protect the privacy of your personal and financial information. Intelligirl, Inc. is not liable for breeches of privacy due to errors on the part of the YourPay.com, its affiliates or associates. Return Policy

Please note: Intelligirl, Inc. does not offer returns, exchanges, refunds or any other alterations to jewelry you make and customize using our Make Jewelry section and pages of the Intelligirl Jewelry Maker website, once you have placed your order. NO EXCEPTIONS. When building a customized piece of jewelry, please make your selections and pick your options carefully and review your item(s) before submitting your order.

Also, Intelligirl, Inc. does not offer returns, exchanges, refunds or any other alterations to pieces of jewelry or other items such as but not limited to beading craft kits sold in our Online Retail Store. NO EXCEPTIONS. Please make your selections carefully and review your item(s) before submitting your order.

Intelligirl, Inc. guarantees customized work and other products sold on the website to be free from damage due to manufacturing or shipping. If your order arrives damaged, broken, or in un-usable condition due to a defect in the manufacturing or shipping process, you may return the damaged merchandise at your expense within 15 days of the date your order was received. A broken bead or a broken or damaged part of the jewelry infrastructure will be fixed or replaced at Intelligirl, Inc.'s discretion and your repaired order will be re-sent back to you at no additional charge for shipping.

It is your responsibility to call 1(646) 256-7479 within 15 days of receiving your order to notify us of the problem with your merchandise. You will be required to submit both the original packing slip and the defective merchandise. This paragraph constitutes Intelligirl, Inc.'s sole obligation as to the merchandise, and you acknowledge that this paragraph sets forth your exclusive remedy for any damage to the merchandise.

Intelligirl, Inc. is not responsible for damaged or broken items after 15 days from the day your order was received. NO EXCEPTIONS.

In the event that the damaged or broken bead or part to be replaced is no longer available due to stock fluctuations or other conditions either beyond Intelligirl, Inc.'s control or not, and the original damaged bead or part is unavailable, you will be contacted by email or telephone and given a chance to modify your bead selection or modify any components or other defective parts. The price of your new replacement order may change based on the replacement bead or beads, parts, or other related components you select. You will be responsible for the difference in price, but your repaired order will be re-sent back to you at no additional charge for shipping.
